Terms & Conditions
1) INTRODUCTION
A. Application of these Terms and Conditions
These Terms and Conditions are incorporated into any contract between the IP Printing and to the customer, which may be updated by IP Printing from time to time without notice to customer.
B. Interpretation
i. In these Terms and Conditions: Business Day means a day on which banks are open for general banking in the State or Territory;
ii. Customer means the person, persons’ firm, corporation, or statutory organization to which the quote is addressed;
iii. Estimate means the estimate referred to in sub clause 2.A
iv. Goods means the final goods produced by the printer by completing the order;
v. Order means the work required to be done in order to fulfil the customer’s instructions;
vi. Quote means the quote described in clause 2.A.
vii. Cut-off time means time of daily confirmation gateway, confirmation after that time of the day is processed the following business day accordingly.
viii. MYT means Malaysia Standard Time Schedule means the time frame from the payment confirmation to the goods being ready for pickup/ delivery.
C. General
i. In these Terms and Conditions, unless the context otherwise requires:
ii. The singular includes the plural and vice versa;
iii. A reference to a clause is a reference to a clause of these Terms and Conditions;
iv. A reference to a party to those Terms and Conditions or any other document or arrangement includes that party’s executors, administrators successors and permitted assigns;
v. Where an expression is defined, another part of speech or grammatical from of the expression has corresponding meaning;
vi. A reference to a period of time (including, without limitation, a year, a quarter a month and a day) is to a calendar period.
D. Heading
In these Terms and Conditions, headings are for convenient reference only and do not affect interpretation.
E. Business Day
If the day on which any act, matter or thing is to be done under this agreement is not a Business Day, that act, matter or thing:
i. If it involves a payment other than a payment which is due on demand, must be done on the preceding business bay; and
ii. In all other cases, may be done on the next business day.
F. Daily Cut-off times
i. If the customer cannot fulfil any, hereinafter time, order will treat as next business day’s order:
ii. Order confirmation time (including artwork submit) – 17:00 (MYT)
iii. Artwork confirmation time – 17:00 (MYT)
iv. Payment confirmation time – 17:00 (MYT)
v. All confirmations including quotation, order and artwork confirmations must be submitted in writing e-mail;
vi. IP Printing will not accept any verbal confirmation.
G. Schedule
Our standard turnaround time is 1-14 business days from payment confirmation date until ready for pick up at our production hub, depending on the product or service required. Turnaround time may also vary or increase depending on the quantity and size of the order and/ or number of artworks supplied.
H.Standard Fees
Standard charges mean printing cost as it clearly shown in the quotation/ order/ invoice.
It exclude: artwork design fee, extra finishing fee; Courier fee & installation fee.
I.Promo Code
If customer wishes to be entitled to IP Printing’s promotions and specials, customer has to quote the Promo Code prior placing order. IP Printing retains the final right to offer promotional offers or specials if promo code is provided after artwork has been confirmed.
2) QUOTES/ QUOTATION/ TAX INVOICES
A. Quotes
i. IP Printing to supply quote
The IP Printing may, if requested by the Customer, give the customer a quote specifying:
a) The work required to be done in order to fulfil the customer’s instructions; and
b) An estimate of the charge for the performance of such work.
ii. Acceptance by customer
a) Where IP Printing has given the customer a quote:
b) IP Printing needs not commence work until the quote has been accepted by the customer.
c) The customer may accept the quote by instructing in writing the printer to commence work.
d) Acceptance by the customer of the quote will constitute acceptance by the customer of these Terms and Conditions.
iii. Quote evidence of instructions
a) If a written quote is accepted by the customer, the work that is subject of the quote shall be carried out and the customer shall pay for the work in accordance within the Terms and Conditions.
iv. Validation of Quote
a) All quotations will only be valid for a maximum of 30 business days. Only IP Printing formal written quote will be accepted as the quotation price.
B. Quotation
i. IP Printing to supply quotation
After customer confirms the quotes, IP Printing will give the customer a quotation specifying:
a) Customer confirm the quotes supplied by IP Printing;
b) The work required to be done in order to fulfil the customer’s instructions; and
c) An estimate of the charge for the performance of such work.
ii. Acceptance by customer
Where IP Printing has given the customer a quotation:
a) IP Printing will commence work without customer acceptance.
iii. IP Printing may revise Estimate
a) IP Printing may amend the Estimate before the order has been completed to take into account any rise or fall in the cost of performing the order and IP Printing shall notify the customer of such amendments, as soon as practicable thereafter. Upon IP Printing giving the customer notification of such amendments, the estimate shall be deemed to be the estimate for the purposes of these Terms and Conditions.
iv. Validation of Quote
a) All quotation will only be valid for a maximum of 22 business days. Only IP Printing formal written quotation will be accepted as the order price.
v. Amendment
a) All amendments are requested via email, IP Printing will not accept any amendments verbally.
b) Extra business day may apply if any amendment after daily cut-off time described in clause F.
C. Tax Invoices
i. IP Printing to supply tax invoice
After artwork confirmation, IP Printing will give the customer a tax invoice specifying:
a) Customer confirm the artwork proof supplied by IP Printing;
b) The work required to be done in order to fulfil the customer’s instructions; and
c) A final charge for the performance of such work.
ii. Acceptance by customer
Where IP Printing has given the customer a tax invoice:
a) IP Printing needs not commence work until the customer makes the payment.
iii. Validation of Quote
All tax invoices will only be valid for a maximum of 22 business days. Only IP Printing formal written quotation will be accepted as the order price.
iv. Paid invoice
IP Printing will supply paid invoice only by customer request.
v. IP Printing may revise Estimate
IP Printing may amend the Estimate before the order has been completed to take into account any rise or fall in the cost of performing the order and IP Printing shall notify the customer of such amendments, as soon as practicable thereafter. Upon IP Printing giving the customer notification of such amendments, the estimate shall be deemed to be the estimate for the purposes of these Terms and Conditions.
vi. Errors and omissions
It is the customer’s responsibility to check that the details on the quotes/ quotation/ tax invoices are correct; IP Printing will not take the responsibility for any error on the order.
3)CHARGES
A. Invoice
Subject to clause 5.A when the artwork has been confirmed, IP Printing will issue an invoice to the customer for the amount of the estimate or, if no estimate was made, for an amount representing IP Printing’s charge for the work done in filling the order, and for any of the other charges specified in clause 3.B
B. Additional Charges
i. In addition to the amount of the Estimate, or where no estimate was given, in addition to the amount representing IP Printing’s charge of work done, IP Printing may charge to the customer minimum (or above) RM30 administration fee:
a) Fees for any preliminary work performed at the customer’s request;
b) Fees for additional work required to be done as a result of the customer changing his, her or its instructions;
c) Fees for having to work from poor copy or poor artwork;
d) Fees for work which involves tables or foreign language and which was not notified to the printer before the quote was prepared;
e) Fees for additional work required to be done as a result of the customer’s corrections;
f) Fees and other charges for work required to be done urgently, including any overtime costs;
g) Fees for handling or storing material or equipment supplied by the customer for the purposes of the order;
h) Fees for installation charges which depends on area;
i) Fees for changing or correcting, in order to ensure that the goods are properly produced, any plates, film bromides, artwork or any document including computer files supplied for the purposes of the order by the customer.
j) Freight costs and charges;
k) Fees for awaiting/ redirection/ redelivery;
ii. Other charges, fees or disbursements referred to in these Terms and Conditions and not specified in this clause.
iii. For the purpose of these Terms and Conditions:
a) The term “IP Printing’s charge” refers in each case to the standard or usual fee charged by IP Printing from time to time in respect of order;
b) “Preliminary work” means all and any work performed by IP Printing at the customer’s express or implied request, the performance of which work was necessary to enable the order to be commenced and which work was not within the reasonable contemplation of IP Printing at the time when IP Printing supplied the estimate.
c) “additional work” includes all work undertaken by IP Printing as a consequence of the customer’s a variation, alteration or modification of its instructions in relation to the order; and
d) “Freight cost and charge” includes all costs and expenses incurred by IP Printing in removing the goods from its premises, whether by way of actual or attempt delivery to the customer or otherwise.
4) DELIVERY
A. Notification
IP Printing shall notify the customer when the goods are ready for collection
B. Pickup/ Delivery
The customer must collect the goods from IP Printing’s premises upon being notified by IP Printing that the goods are ready for collection. If IP Printing agrees to deliver the goods, the customer shall bear all freight costs and charges of such delivery.
i. Pick up
a) Customers pick up – Customers request to sign the pickup form, on the spot, by accepting the quality and quantity of the goods upon picking up the order.
b) Pick up via courier (organized by IP Printing or customer)
c) Order/ invoice number must be provided at the time of pick up. Failure to do so may extend the pickup time to 30 minutes or above.
d) IP Printing has no liable of completing any form/ document requested by the courier, it is the customer liable to provide the corresponding form/ document to IP Printing, one business day before pickup date.
e) IP Printing had no liable on any extra delivery cost/ delay due to the lack of information when pick up.
ii. Delivery
a) Customer must ensure someone is available to receive the goods between 9.30am – 6.30pm of the target delivery date on the tax invoice. If no one attends to receive the delivery, an extra fee will apply for any re-delivery/ re-direction/ awaiting fee. If any additional delivery action takes place such as re-direction, customer has the liable for the extra cost.
b) The target date on invoice is only an estimate delivery date of the goods.
c) IP Printing had no liable of the schedule amendment caused by the courier company.
C. Rejection
Subject to clause 7.A the customer may only reject the goods if they do not comply with the customer’s instructions. If the customer wishes to reject the goods, the customer must notify IP Printing of the rejection and return the goods to IP Printing for inspection:
a) If IP Printing agrees to deliver the goods to the customer’s premises within 7 days of delivery (or such either time as is mutually agreed);
b) Otherwise – within 7 days of notification that the goods are ready for collection (or such other time as is mutually agreed).
D. Risk
i. The risk in the goods passes to the customer:
a) If IP Printing agrees to delivers the goods to the customer’s premises – at the time of departure from IP Printing premises;
b) Otherwise – at the time IP Printing notifies the customer, that the goods are ready for collection. If the customer is entitled to reject the goods and rejects the goods, in accordance with these Terms and Conditions, risk reverts to IP Printing at the time the customer notifies the IP Printing, that the goods are rejected.
ii. If you do not receive the products ordered by you within 10 business days of the dispatch date, we shall have no liability to you unless you notify us in writing by email of the situation, within 3 business days of the dispatch date.
5) PAYMENT
A. Types of Payment Terms
IP Printing offer three (3) types of payment terms:
i. Prepaid – The order will not be processed until the customer pay to IP Printing the total amount set out in the invoice;
ii. 30 Day Account (customer must meet IP Printing’s requirements) – The customer must, within 30 days of the customer receiving IP Printing’s invoice, pay to IP Printing the total amount set out in the invoice;
iii. If IP Printing invoice specifies a different time for payment, then the customer shall pay the total amount set out in the invoice by that time.
B. Payment method
IP Printing accepts e-wallet/ direct debit/ internet banking or cheque (not recommended):
i. Payment via e-wallet/ direct debit/ internet banking – IP Printing requests customer email bank transfer acknowledgement with a receipt number to be forwarded to IP Printing via email (ipadm9657@gmail.com ) and attention this to “Accounts Receivable” As soon as customer have received it to prevent unnecessary delays. Reseller account holder is NOT equivalent to Credit Account holder.
ii. Payment via cheque (not recommended) – IP Printing will only process the order after the cheque has been cleared. This will delay the production of customer’s order.
iii. Payment terms have been indicated on the top left hand corner where “Account Terms” specified on the front page of the order or tax invoice. If it specifies “Prepaid” then full payment must be received by the criteria stated on clause 5.A (i). If it specifies “In 30 Days” then IP Printing will precede the order to production phrase directly, if the account total outstanding did not exceed the credit limit of customer account. In case of the account’s total outstanding, is exceeding customer’s credit limit IP Printing will either contact customer to request payment or IP Printing’s finance department will approve the job to supply on credit as an exception.
C. Differences
There would be price differences between order and invoice due to the last minute amendment requested by the customer, IP Printing will treat the fee on the tax invoice as the finalized fee of this order.
D. Payment delay
i. If the customer cannot fulfil the payment time frame on the invoice:
a) Goods may not be allowed to be picked up/ being dispatch; or
b) The schedule will amended by IP Printing and/or additional charges will apply; or
c) Customers IP Printing account being suspended
ii. An updated production schedule will be emailed to you once we have processed your payment.
iii. IP Printing bear no responsibility of any lost, dispatch or delivery delay if the payment has not been processed or forwarded the required proof according to clause 5.B listed above.
E. Advance and progress payments
i. IP Printing may issue an invoice for the amount of the estimate before commencing the order, where the printer has not previously carried out work for the customer or whereby, the printer considers it otherwise prudent to do so;
ii. IP Printing may in the event that IP Printing is, of the view that completing the order is completed, issue one or more invoices for a proportion of the amount of the estimate (the proportion to be at IP Printing’s discretion) and require that proportion of the estimate, to be paid in advance of any further work being done.
iii.If the order is suspended for more than 30 days at the request of the customer, or as a result of something for which the customer is responsible for, IP Printing may issue an invoice for a particular sum (to be specified by IP Printing) for the work already done and for other costs incurred by IP Printing (such as storage costs).
F. Damages
i. If IP Printing agrees to deliver the goods to the customer’s premises within 7 days of delivery (or such other time as is mutually agreed);
ii. Otherwise – within 7 days of notification that the goods are ready for collection (or such other time as is mutually agreed).
iii. The customer must pay to IP Printing any costs, expenses or losses incurred by IP Printing as a result of the customer’s failure to pay to the printer, all sums outstanding from the customer to the customer to IP Printing (including, without limiting the generality of the obligation set out in this clause, any debt collection and legal costs).
6) NON-PAYMENT
A. Retention of Ownership
Until the customer has paid all sums outstanding in relation to the goods:
i. Title in the goods shall not pass to the customer
ii. If the goods are in the customer’s possession, the customer shall hold the goods as trustee for IP Printing and must store the goods so that they are clearly identifiable as the property of IP Printing.
iii. IP Printing may call for and recover possession of the goods (for which purposes IP Printing’s employees or agents may enter the customer’s premises and take possession of the goods, without liability to the customer) and the customer must deliver the goods to IP Printing, if so directed by IP Printing.
iv. The customer may, in the ordinary course of the customer’s business, sell the goods to a third party but:
a) The proceeds of sale to the third party shall be held by the customer as trustee for IP Printing and the customer account to IP Printing for those sums and
b) If IP Printing requires, the customer shall assign to IP Printing the customer’s claim against the third party and shall execute all documents necessary to effect that assignment.
B. General Lien
IP Printing shall in respect of all sums owned by the customer to IP Printing here under have a general lien on all property of the customer in IP Printing’s possession and may after 14 days notice to the customer sell that property and apply the proceeds (net of any sales costs) in satisfaction of all or any part of the sums owed. In the event that any of the customer’s property held by IP Printing as aforesaid enjoys copyright protection in favour of the customer, the customer hereby grants to IP Printing a license to exercise the exercise the rights conferred on IP Printing under this clause.
7) LIABILITY
A. Artwork Proofs
i.Artwork/ Design Proofs If IP Printing submits to the customer an artwork/ design proof of the goods IP Printing will not be responsible for any errors in the goods which appeared in the proof and which were not corrected by the customer before the order was completed.
ii.IP Printing had no responsible for any discrepancies after artwork has been approved.
iii.IP Printing will not be liable for failure by the customer to ensure the artwork provided to IP Printing is correct.
iv.Any change make after artwork confirm will incur minimum (or above) RM30 administration fee.
B. Liability of Goods
Customer will become the owner of the goods customer has ordered when delivered to customer. Once the goods have been delivered to the customer, the customer will be responsible for insurance as the goods will be held at the customer’s risk and IP Printing will not be liable for any loss or destruction.
C. Non-excusable Rights
The parties acknowledge that under applicable State and Commonwealth Law certain conditions and warranties may be implied in these Terms and Conditions and there are rights and remedies conferred on the customer in relation to the provision of the goods or of services which cannot be excluded, restricted or modified by agreement (“Non-excusable Rights”)
D. Disclaimer of Liability
IP Printing disclaims all conditions and warranties expressed or implied and all rights and remedies conferred on the customer, by statute the Common Law Equity Trade Custom or usage to otherwise and all those conditions and warranties and all those rights and remedies are excluded other than any Non-excusable rights. To the extent permitted by law, the liability of IP Printing for breach of a non-excludable right is limited, at IP Printing’s option to the supplying of the goods and or any services again or payment of the cost of having the goods and or any services supplied again.
E. Indirect Losses
i. Notwithstanding any other provision of these Terms and Conditions, IP Printing is in no circumstance (whatever the cause) liable in contract, tort (including without limitation, negligence or breach of statutory duty) or otherwise to compensate the customer for:
a) Increased costs or expenses;
b) Any loss of profit, revenue, business, contracts or anticipated savings;
c) Any loss or expense resulting from a claim by a third party or;
d) Any special, indirect or consequential loss or damage of any nature whatsoever, caused by the printer’s failure in completing the order or to deliver the goods.
F. Electronic Data
Without limiting the generality of the foregoing clauses, IP Printing will not be liable to the customer for loss, however caused, of any data stored on disks, tapes, compact disks or other media supplied by the customer to IP Printing.
G. Customer’s Property
Subject to clause 7.B IP Printing will not be liable for the damage, loss or destruction of any property of the customer in IP Printing’s possession, unless the loss or damage is due to the failure of IP Printing to exercise due care and skill, in handling or storing the property.
H. Force Manure
IP Printing will have no liability to the customer in relation to any loss, damage or expense caused by IP Printing’s failure to complete the order or to deliver the goods as a result of fire, flood, tempest, earthquake, riot, civil disturbance, theft, crime, strike, lockout, breakdown, war, the inability of the printer’s normal suppliers to supply necessary materials or any other matter beyond the printer’s control.
8) Design
A. Alterations to style etc
If before the quote is prepared, the customer does not give IP Printing specific instructions in relation to style, type or layout:
i. IP Printing may use any style, type and layout which in IP Printing’s opinion, is appropriate and;
ii. IP Printing may charge an additional amount for any additional work required to be down (including the production of additional prods) as a result of the customer subsequently, altering the style, type or layout used by IP Printing.
B. Ancillary materials
Unless IP Printing and the customer agree otherwise, drawings, sketches, painting, photographs, designs, typesetting, dummies, models, negatives, positives, blocks, engravings, stencils, dies, plates or cylinders, electros, stereos, discs, tapes, compact discs, or other media or data and other material produced by IP Printing in the course of, or in preparation for performing the order (whenever or not in fact used for the purposes of performing the order) are the property of IP Printing.
C. Charge
i. Fees quoted only for professional services do not include purchases of photos, printing, colour-matching, shipping and handling or courier service. Expenses are itemized on each invoice.
ii. If customer requires artwork on CD, an administration fee applies (min. RM150) excluded courier/ delivery costs will be payable by customer.
D. Copyright
i. Licensing of copyright is subject to a mutual agreement made between client and designer’. Copyright will remain property of IP Printing till such an agreement is in place. As part of IP Printing‘s Terms of Business, the copyright license is automatically released to the client on receipt of final payment for the commissioned work.
ii. IP Printing reserves the right to use all artwork produced for the purposes of promoting IP Printing in print, publication or website, unless explicitly denied to do so by client in writing.
iii. Copyright in all artistic and literary works authored by IP Printing shall be the property of IP Printing.
a) Warrants that the customer has copyright in or a license to authorize IP Printing to reproduce, all artistic and literary works supplied by the customer to IP Printing for the purposes of the order and the customer hereby expressly authorizes IP Printing to reproduce all and any of such works for the purposes aforesaid;
b) Hereby indemnifies and agrees to keep indemnified IP Printing against all liability, losses or expenses incurred by IP Printing in relation to or in any way directly or indirectly connected with any breach if copyright or of any right in relation to copyright in such literary and artistic works supplied as aforesaid, and;
iv. The customer is hereby granted a non-exclusive license to use the copyright in any literary and/or artistic works authored by IP Printing for the purposes of the order however, the exercise of such license shall be conditional upon IP Printing having received all monies due to the printer under these Terms and Conditions.
v. Artwork, images and copy supplied by the customer, will be the customer’s own responsibility. IP Printing will take no responsibility for copyright issues regarding such artwork, images and copy. The customer is responsible for all trademarks, service mark, and copyright.
E. Design Process
To commence the design process customer request to sign on the design agreement and return via email to IP Printing.
F. Errors and omissions
It is the customer’s responsibility to check proofs carefully for accuracy in all respects, ranging from spelling to technical illustrations. IP Printing is not liable for errors and omissions.
G. Amendment
All amendments are requested via email, IP Printing will not accept any amendments, verbally.
H.Confirmation
Orders will only be processed when the customer confirms the artwork via email. Schedule will amend based on the artwork confirmation date before cut off time.
I.Additional editing and changes
a) Assuming all the aspects of the clients brief are met, the client is permitted to make 3 additional changes free of charge. Anything after this will incur an additional RM30 per change.
b) If the changes differ greatly from the original request, a new design fee may be issued instead, based on the complexity and time it will take to complete.
c) All additional editing and changes requested after artwork confirmation, an additional administration fee of RM30 and extra design fees may apply, plus a new quote and amended schedule submitted to the customer for the additional changes.
J. Cancellation
If the customer wishes to cancel the job:
a) After design agreement is signed off – Full design fee must be paid
b) After artwork confirmation received – Full design fee must be paid
K. Ideas
The customer must keep confidential and not use any ideas communicated by IP Printing to the customer without IP Printing’s written consent.
9) Warranty Claim
A. Claim period
i. Disputes and or claims must be submitted to IP Printing within 7(seven) business days of receipt of order. Claims submitted after 7 (seven) business days, IP Printing has the right to refuse the claim.
ii. The warranty claim must be submitted via the IP Printing warranty claim form.
iii. Claims not supported by photographs that clearly show the product, where and how it was installed, IP Printing will not accept this claim.
iv. If any of our products are delivered damaged or defective, then we shall not have any liability to you, unless the customer notifies IP Printing in writing via email, of the problem within 7 (seven) business days of the delivery of the goods.
v. IP Printing shall not be liable in respect of any work done by third party(s).
vi. IP Printing shall not be liable in respect of any claim, unless the aforementioned requirements have been complied with, except in any particular case where the customer proves that
vii. it was not possible to comply with the requirements and
viii. advice (where required) was given and the claim was made as soon as reasonably possible.
B. Colour Variation
i. IP Printing have made every effort to display, as accurately as possible, the colours of the products that appear on the website. However, as the actual colours customer see will depend upon the monitor, IP Printing cannot guarantee that the customer’s monitor will display of any colour accurately.
a) IP Printing has no liable on colour discrepancies between artwork supplied and the actual printed order, if the customer does not request and pay for the colour matching service.
b) IP Printing has no liable on colour discrepancies between different materials/ goods/ time frame customer order.
Acceptance of Terms of Usage
These Terms of Usage govern your access and use of this Site. By accessing or using this Site you agree to be bound by these Terms of Usage and to any additional guidelines, restrictions, or rules that may be posted in connection with specific sections or services of this Site. All such additional posted guidelines, restrictions, or rules are hereby incorporated by reference into these Terms of Use.

Information on the website is not financial advice – customer should obtain advice before making any decisions based on the information found on this website.
B. Pricing
IP Printing have detailed a range of products and prices available. Although the prices are correct at the time of printing, they are indicative only, as prices and stock may vary from printed to online advertising. All prices were provided by relevant retailers and suppliers. IP Printing advise customers to contact IP Printing’s Sale Office for further information about prices and product availability.
C. Liability
i. By accessing this website, you agree to these terms and acknowledge reading them.
ii. IP Printing does not take responsibility for the websites of other organizations, whether or not linked, or any device used to access or views the website.
iii. IP Printing does not accept any responsibility for price variations or errors, availability or quality of products. No responsibility is accepted by IP Printing for the accuracy of any statement or advice contained in the text or advertisements or the accuracy of any prices quoted.
iv. IP Printing website has been prepared under Malaysia law. Nothing it states constitutes an offer of securities, or an invitation to subscribe for securities, enter into any legal agreement or exercise any rights in relation to the offering of any financial product, or amount to a solicitation for any business.
D. Account
By accessing the website, the customer is responsible for maintaining the confidentiality of their account and password and for restricting access to their computer, and the customer agrees to accept responsibility for all activities that occur under their account or password. IP Printing reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at their sole discretion.
E. Copyright
All content included on this website, such as text, graphics, logos, button icons, images, audio clips, video, digital downloads, data compilations and software, is the property of IP Printing or its content suppliers and protected by Malaysian and International Copyright laws.
F. Privacy Policy
Registration Data and certain other information about customer are subject to IP Printing’s privacy policy. Customer understand that through customer use of the Service customer consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the Malaysia and/or other countries for storage, processing and use by IP Printing and its affiliates.
11) GENERAL MATTERS
A. Overset
The customer must pay for overset matter (being matter produced on the customer’s instructions but not used in a publication for which it was intended). The customer may instruct IP Printing to retain overset matter for future issues of the campaign or to discard the overset matter.
B. Outside work
i. If IP Printing has to obtain goods (including typefaces, bromides, film, plates, ornaments or artwork) and/or services not normally stocked or supplied by the IP Printing from a third party in order to carry out the customer’s instructions.
a) IP Printing will not be liable for any breach of these Terms and Conditions if that breach is a result of, or is connected with the supply of, by the third party of such goods and/or services.
b) IP Printing acquired such goods and/ or services as the agent for the customer and not as principal and will have no liability to the customer in relation to the supply of those goods and/or services. Any claim by the customer in relation to supply of those goods and/ or services must be made directly against the third part
c) The customer must pay for such goods and or services
d) Property in any such foods obtained from a third party and incorporated into the goods passes to IP Printing at the time of incorporation.
C. Material supplied by customer
i. If IP Printing and the customer agree, the customer is responsible for supplying materials or equipment for the purpose of the order:
a) The customer must supply sufficient quantities of materials to allow for spoilage, such quantity to be specified by the printer.
b) IP Printing will not normally count or check the material and if requested by the customer to do so may charge for counting or checking
c) IP Printing will not be responsible for any defects in the goods which are caused by defects in or the unsuitability of materials or equipment supplied by customer.
d) Property in any materials supplied by the customer an incorporated into the goods passes to IP Printing at the time of incorporation
D. Property left with IP Printing
If the customer leaves property in IP Printing’s possession without specific instructions as to what is to be done with it, IP Printing may, 3 (three) months after gaining possession of the property, dispose of/or sell the property and retain any proceeds of sale as compensation for holding and handling the property.
E. Responsibility to insure
IP Printing has no obligation to insure any property of the customer in IP Printing’s possession. The customer must pay the cost of any insurance arranged by IP Printing at the request of the customer.
F. Storage of electronic data
IP Printing will not be responsible for storing any data on disks, tapes, compact disks or other media when the order has been completed. If IP Printing agrees to store such data, IP Printing may charge for doing so.
G. Credits
Any credits offer, if not being redeemed within 90 (ninety) days will become invalid.
H. Severability
i. Any provision in these Terms and Conditions which is invalid or unenforceable in any jurisdiction must be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable, if that provision cannot be read down then it is capable of being severed to the extent of the invalidity or unenforceable without affecting the remaining provisions of these terms and conditions or affecting the validity or enforceable of that provision in any other jurisdiction.
ii. A 5% charge of the total value of the original order will be made on all cancelled orders together with a RM30 charge to cover the administrative costs. IP Printing will be entitled to payment for work already carried out, any materials specially ordered and any other reasonable additional costs incurred by IP Printing in relation to the order.
I. Governing law and jurisdiction
i. These Terms and Conditions are governed by the law in force in Malaysia and the parties submit to the non
ii. exclusive jurisdiction of the courts of that state or territory and any courts which may hear appeals from those courts in
iii. respect of any proceedings in connection with these terms and conditions.
H. Variation to Terms and Conditions
i.These terms and conditions may be amended from time to time. The latest version of these Terms and Conditions may be accessed via IP Printing’s website.
12) SALES & SALES TAX (SST)
A. All listed prices are SST exclusive
i. Unless otherwise stated, all amounts expressed or described in these Terms and Conditions are SST exclusive amounts.
B. Out of pocket expenses are SST exclusive
C. All out of pocket expenses referred to in these terms and conditions are GST exclusive.
13) INSTALLATION SERVICE
A. Claim period
Any disputes and or claims must be submitted to IP Printing within 3 (three) business days from the installation date. Claims submitted after 3 (three) business days from the installation date, IP Printing has the right to refuse the claim and may treat the job as completed.
B. Accurate information
If an initial site inspection is not requested it is the customer’s responsibility to provide accurate details including precise measurements to IP Printing. IP Printing has the right to reject the installation upon arrival if the installation requirements have not been met. Payment will still apply for the installation if the installation cannot proceed for reasons outside the control of IP Printing.
C. Weather Conditions
Rescheduling may apply if weather conditions are dangerous to the installer.
